STATE OF EMERGENCY DECREES 2017


Decree No. 679 - 6 January 2017

Trustee councils replace daycare with Quran courses,
sack 2,000 officials

2,687 security workers and 631 academics were dismissed from service. 277 public officers returned to their jobs, 83 associations were shut down. 7 associations were allowed to be re-opened after being shut down. 11 newspapers, previously shut down with Statutory Decrees, were re-opened.

Decree No. 680 - 6 January 2017

367 people were dismissed from public service; 124 have returned to their jobs. Broadcasts of channels showing material against bans were decided to be temporarily cut. Turkish citizens who wave investigations or prosecutions against them and who are not able to be reached due to being abroad were decided to be removed from Turkish citizenship in case they don’t return to the country within three months after the announcement of “Come Back to Turkey” call to be made on the Official Gazette.

Decree 680 of 6 February 2017 (87 articles) amends the Law on Police Duties and Responsibilities by granting broad control over internet; and gives the authorities the power to revoke citizenship of individuals under
investigation who remain abroad.**

Decree No. 681 - 6 January 2017

Amendments were made at the Turkish Armed Forces Internal Service Act. Authorities of the Chief of General Staff on classification of officers, identification of general staff and service periods were restricted. Authority on Supreme Military Council (YAŞ) decisions were assigned to the Minister of National Defense. Ministry of National Defense were allowed to conduct disciplinary investigations on Turkish Armed Forces members.

Decree No. 682 - 23 January 2017

Disciplinary regulations were made at the Security, Gendarmerie and Coast Guard.

Decree No. 683 - 23 January 2017

367 people were dismissed from public service; 124 returned to their jobs. Associate professorship applications of those who have investigations against them were frozen. 2 TV channels were shut down.

Decree No. 684 - 23 January 2017

Some service procurements of the Central Bank were removed from the scope of the Public Procurement Law.

There has been an amendment on the Decree No. 667 concerning the duration of custody. The duration of the custody was reduced from 30 days to 7 days. If there is a need, the public prosecutor will be able to extend the duration for another 7 days. A temporary article was also added to the Decree as follows: “Before the date of the publication of this Decree (23 January 2017), period of detention for persons taken into custody shall be maximum thirty days for crimes defined in the fourth, fifth, sixth and seventh chapters of the second chapter of the Turkish Criminal Code & crimes falling within the scope of Anti-Terrorism Law*

Decree No. 685 - 23 January 2017

A 7-people State of Emergency Applications Monitoring Commission was established to monitor decisions regarding the emergency decrees. The commission was determined to work for two years and its members were decided to be assigned within a month. Actions for nullity against the commission decisions were allowed to be made at Ankara Administrative Courts to be determined by the Higher Council of Judges and Prosecutors (HSYK). The commission was exposed to criticisms on the ground that it will never be an effective domestic remedy. The commission started its work only after the first anniversary of the State of Emergency.

Decree No. 686 - 7 February 2017

330 academics were dismissed from public service, especially from Ankara University Faculty of Political Sciences and Communication. A total of 4,464 people were dismissed from public service.

Decree No. 687 - 9 February 2017

License and copyrights of private radio and TV channels, which were shut down due to the State of Emergency, were allowed to be sold. Sanctions on broadcasting institutions not abiding by broadcast bans were removed by the Higher Electoral Board.

Decree No. 688 - 29 March 2017

416 people, previously dismissed from public service, returned to their jobs.

Decree No. 689 - 29 April 2017

3,974 people were dismissed from public service, 235 were assigned back their jobs. 14 associations, 1 newspaper, 1 magazine, 18 foundations and 13 health institutions were shut down. 5 associations, which were previously shut down with emergency decrees, were re-opened. The inscription “or other terrorist organizations” was added to the expression “Fethullah Terrorist Organization (FETÖ/PDY)”in the Statutory Decree No. 670 of the State of Emergency. Thus, some sanctions applied with previous emergency decrees were based on legal grounds with an amendment made on a document released in the past.

Decree No. 690- 29 April 2017

Authority in the investigation of the Council of Judges and Prosecutors (HSK) was removed from the Council and assigned to the Court of Appeals Chief Public Prosecutor’s Office. Travels of rectorates abroad were bound to permission by the Council of Higher Education (YÖK).

Decree 690 of 29 February 2017 (77 articles) is an omnibus legislation which, for instance, bans certain television programmes; and amends the Population Services Law regarding the procedure to register divorces, among other matter.**

Decree No. 691 - 22 June 2017

With a clause added to the Military Law, police were obliged to recruit draft evaders and deserters having connections to FETÖ in accordance with summons and conscription principles to be determined by the Ministry of National Defense. Thus, “unfavorable” inductions were allowed.

Decree No. 692 - 14 July 2017

2,303 people were dismissed from the Security General Directorate and 1,486 were dismissed from the Ministry of Internal Affairs. A total of 7,348 were dismissed from public service.

Dismissal of public servants and the closure of institutions and organizations deemed to be a threat to national security or affiliated with terrorist organizations.

Reinstatement of those persons or institutions/organizations cleared of such charges; and

Stripping of privileges of certain retired armed forces personnel. Decree 694 of 25 August 2017 (205 articles) amends a large number of various important laws, including the Law of the Judges and Public Prosecutors, the Law of Civil Procedure, the Military Law, the Law of the personnel of the Turkish Armed Forces, the Law of the State Intelligence Services and National Intelligence Organization, the Security Organization Law, the Law on the Foreigners and International Protection; the Turkish Commercial Code, the Law on Higher Education, Student Dormitories and cafeterias, among other laws.**



Decree No. 695,
7 associations and 7 institutions, including 7 foundations, were closed, a previously closed foundation was opened and 6 people studying abroad were interrupted. In this context, the Mediterranean newspaper which is broadcasting in Isparta center and Çınaraltı newspapers which is broadcasting in Yalvac were closed down.
